Special Terms for Digital Courses and Content
These Special Terms supplement our general Terms of Service and apply specifically to digital courses, coaching services, guided sessions, and related digital content provided by DITTRICH & PARTNERS GmbH. By purchasing or accessing our digital services, you agree to these Special Terms in addition to our general Terms of Service.
1. Definitions
For the purpose of these Special Terms:
- "Services" means digital courses, coaching sessions, guided sessions, breathwork sessions, hypnotherapy, online training, or other digital content provided by DITTRICH & PARTNERS GmbH.
- "Customer" means any person or entity that purchases or accesses our Services.
- "Platform" means the online environment through which our Services are delivered, including the FIVE MOVES Academy.
- "Materials" means all content, resources, exercises, and documents provided as part of our Services.
2. Service Delivery
2.1 Online Courses
- Access to online courses is granted for the period specified in the course description
- Standard access duration is 12 months from the date of purchase unless otherwise specified
- We reserve the right to update and modify course content to ensure quality and relevance
- Technical requirements for accessing courses are specified in the course description
- Content is delivered through the FIVE MOVES Academy via password-protected access
- A free module is available for each course, and the curriculum is viewable before purchase
2.2 Coaching and Guided Sessions
- Sessions are conducted via video conference (Zoom) or in-person as agreed upon booking
- The duration of each session is specified in the service description
- Coaching packages expire 6 months after the purchase date unless otherwise specified
- Rescheduling is subject to our cancellation policy (see Section 5)
2.3 FIVE MOVES Training
- FIVE MOVES training and certification is conducted according to the specific program structure
- Certification requirements must be met as specified in the program description
- Practice sessions and supervision may be required for certification completion
3. Access and Account Security
- You are responsible for maintaining the confidentiality of your login credentials
- You agree not to share your login information with third parties
- Purchase of a course or program grants access for one individual unless explicitly stated otherwise
- Group or team access requires separate agreements and appropriate licensing
- All users must be at least 18 years old to access our courses and digital content
4. Payment Terms
4.1. Prices and Currencies
- Service prices are displayed in Swiss Francs (CHF), Euros (EUR), or US Dollars (USD) as indicated
- All prices include applicable Swiss VAT for Swiss customers
- For international customers, the following tax regulations apply:
- EU: Prices include applicable VAT according to EU regulations
- USA/Canada: Taxes are calculated at checkout based on state/province
- Other countries: You may be responsible for additional local taxes
- B2B customers with valid VAT ID (EU) or comparable tax number may purchase without VAT (reverse charge mechanism)
4.2. Payment Methods
We offer the following payment methods:
- Stripe for online payments and credit card payments
- SumUp for on-site payments and mobile card payments
- Bank transfer (invoices due within 10 days of invoice date)
4.3. Payment Plans and Late Payments
- Payment plans, if offered, are subject to specific terms outlined during purchase
- Late payments on invoices may result in suspension of access to Services until payment is received
5. Cancellations and Refunds
5.1 Coaching and Guided Sessions
- More than 48 hours in advance: Free rescheduling possible
- 24-47 hours in advance: 50% rescheduling fee
- Less than 24 hours in advance or no-show: 100% fee (no refund)
- We reserve the right to reschedule sessions when necessary, providing at least 24 hours' notice
5.2 Online Courses and Digital Content
For consumers in the EU and Switzerland:
- 14-day withdrawal right from contract conclusion without stating reasons
- This withdrawal right expires once you have accessed or downloaded the digital content

For consumers in the USA/Canada:

- Additional guarantees that cannot be excluded
Other regions:
- Local consumer protection laws of your country apply
Important: After accessing course content or after expiration of the respective withdrawal period, no refund is possible. You acknowledge that by purchasing and accessing our digital content, you understand and accept this policy.

6. Intellectual Property Rights

- Recording of live sessions is prohibited unless explicitly permitted in writing
6.2. FIVE MOVES® Methodology
- The FIVE MOVES® methodology, including its sequence, wording, and structure, is the exclusive property of DITTRICH & PARTNERS GmbH
- The trademark is currently under registration proceedings
- Unauthorized use of the FIVE MOVES® methodology, branding, or related materials constitutes intellectual property infringement and may result in legal action
7. Confidentiality and Privacy
- All information shared during coaching or guided sessions is treated confidentially
- We may use anonymized case studies for educational or marketing purposes without disclosing personally identifiable information
- Group sessions and programs have specific confidentiality agreements that all participants must adhere to
- Processing of personal data is conducted according to our separate Privacy Policy
8. Health and Wellness Disclaimer
Important Notice: Our Services are not a substitute for professional medical or psychiatric treatment.
8.1. General Notices
- Our Services, particularly breathwork, hypnotherapy, guided sessions, and shamanic coaching, do not replace medical treatment
- Customers with health conditions should consult their physician before participation
- Participation in breathwork, hypnotherapy, and other body-based practices is at your own risk
8.2. Participation Requirements
You confirm that you:
- Are physically and mentally able to participate in the sessions
- Have informed us of relevant health conditions
- Take responsibility for your own health
- Will seek professional medical advice if concerns arise
8.3. Right to Refuse Service
We reserve the right to refuse service to individuals if we believe our Services may not be suitable for their condition.
9. Certification and Professional Use
9.1. Certification Requirements
- Completion of our training programs does not guarantee automatic certification
- Certification requirements are specified in the respective program descriptions and must be fully met
- Use of our methods for professional purposes may require specific certification or licensing
9.2. FIVE MOVES® Practitioner
- The FIVE MOVES® methodology is subject to specific terms of use provided during certification training
- Certified practitioners receive a separate license agreement for professional use
10. Service Quality and Support
10.1. Quality Standards
- We strive to provide high-quality Services and will make reasonable efforts to address any issues or concerns

- Content-related questions are answered during scheduled Q&A sessions or within the Platform's communication channels

- No refund will be granted for termination due to violations of our Terms

13. Limitation of Liability for Digital Services
13.1. No Success Guarantee
- We do not guarantee specific results or outcomes from our Services
- Success depends on individual application and implementation
13.2. Liability Limitation
- Our liability is limited to the amount paid for the specific Service
- We are not liable for technical issues beyond our control (e.g., internet connection problems)
- For coaching, guided sessions, and breathwork sessions, customers assume responsibility for their experience and implementation
13.3. Regional Liability Provisions
- EU/Switzerland: Liability for slight negligence excluded, except for breach of essential contractual obligations
- USA: No liability for indirect, special, incidental, punitive, or consequential damages
- Australia: Guarantees under Australian consumer law remain unaffected
14. International Provisions
14.1. Export Control and Sanctions
You confirm that you:
- Are not located in a country subject to embargo
- Are not listed on any sanctions list
- Will not use our Services for illegal purposes
14.2. Local Laws
- You are responsible for compliance with all local laws regarding access to our Services
